Terms & conditions of use

Please read the following terms carefully before using OMICall services. By registering for and using the services, you agree to be bound by all of these terms.

This English translation is provided for convenience. In case of any discrepancy, the Vietnamese version prevails.

1 Terms on user accounts

  1. You must provide your email address, phone number and other necessary related information (business name, business owner name, etc.) in order to receive our full user support policy.
  2. You should be aware that OMI will use your email address and phone number as the main means of communication between the two parties.
  3. You are obliged to keep your own password confidential. OMI is not liable for any damage arising from your failure to keep your password secure.
  4. You bear full responsibility for the data you upload to your OMI account. You must not store files containing inappropriate content, viruses or code that affects the system.
  5. Any violation of the terms of use will be terminated immediately, including all of the OMI services you are using.
  6. You must not use OMI for the purpose of telephone harassment. Using a call center number belonging to OMI to harass, insult, distort or humiliate others will be subject to administrative penalties or criminal prosecution under the provisions of the law.
Summary

Do not use OMI for anything that violates the law. If you breach the terms of use, we will cancel all services being provided to you. All necessary communications will be sent by email.

2 Account activation

  1. The person who registers to use the service is regarded as the account owner and is subject to all of the service terms of use.
  2. If the person who registers to use OMI's service is your employee, that employee is the account owner.
Summary

The person who directly registers to use OMI's service is responsible for that account, which also means agreeing to all of OMI's terms of service.

3 General conditions

  1. You must not use OMI's services for anything unlawful — under the law of the country where you do business as well as the laws of Vietnam.
  2. You must not copy, sell or use these terms for personal purposes without OMI's written permission.
  3. You bear full responsibility before the law for the content posted on the application, in accordance with the culture and the law of your country of residence.
  4. You must not use any Search Engine related marketing tool or keyword purchase (such as Google Adwords) that contains OMI's copyrighted images or logo.
  5. Any question about the Terms of service may be sent to contact@omicall.com.
  6. You need to understand that the content information on your website (excluding login passwords) is not encrypted for security.

You acknowledge and agree that you are bound by these terms of use. Please read them carefully before becoming an OMI user.

4 OMI's rights

  1. We have the right to modify or terminate the service for any reason without prior notice.
  2. We have the right to refuse to provide the service to any individual for any reason.
  3. We may delete content or any account that is unlawful, offensive, defamatory, threatening, obscene or that deliberately infringes intellectual property.
  4. Delete any account that deliberately infringes upon or insults, verbally or in writing, OMI's customers, OMI's employees or OMI company.
  5. OMI does not pre-screen or review the content on users' websites; users are responsible for their own content.
  6. We have the right to provide services to your competitors and do not commit to exclusivity for any partner in any segment.
  7. In the event of a dispute over account ownership, we have the right to request documents certifying ownership (business licence, personal identification papers, etc.).
  8. OMI has the right to decide on the lawful ownership of an account. If it cannot be determined, OMI will temporarily freeze the account until a conclusion is reached between the disputing parties.
Summary

We may modify, cancel or refuse to provide the service at any time. When there is a dispute over account ownership, we may freeze the account or transfer ownership to the most lawful party.

5 Limitation of liability

  1. You clearly understand and agree that OMI will not be liable for any damage — whether direct, indirect or incidental — in particular damage to profits, reputation, right of use, data or other intangible losses when using the service.
  2. OMI and its cooperating service providers will not be liable for loss of profits or damage arising from the connection to the website, our services or this agreement. If you use the service of a third party, you must comply with that party's commitments.
  3. Our services and products are provided at a basic level and without any statutory warranty terms.
  4. OMI does not guarantee that the service will be uninterrupted, always secure or free of errors.
  5. OMI does not guarantee that the results obtained from using the service are absolutely accurate and reliable.
  6. OMI does not guarantee that the quality of every product, service or piece of information you purchase or obtain through the service will meet your expectations; if an error arises, we will remedy it as far as conditions allow.
Summary

We are not liable if you violate the law, breach these terms or act against the rights of a third party. The service may have errors or interruptions and we do not guarantee otherwise.

6 Waiver and entirety of the agreement

  1. If OMI makes a mistake or does not properly perform any provision of these terms of use, that does not mean the provision is cancelled. These terms are regarded as the entire agreement between you and OMI and govern your use of our services.
Summary

If OMI does not enforce a provision, that does not mean the provision is abolished. Where there is a conflict between versions, the provisions of the latest version apply.

7 Intellectual property and customer content

  1. We do not claim any intellectual property rights over the materials you provide to OMI's service. All materials you upload belong to you alone. You may delete all content at any time by deleting your account.
  2. By uploading content, you agree: (a) to allow other internet users to view your content, (b) to allow OMI to display and store that content, and (c) that OMI may view the data you have uploaded.
  3. You retain ownership of all your content; however, uploading it means you agree to let others view it. You are responsible for whether the content complies with the law.
  4. We will not disclose your information to third parties, except in mandatory cases such as a dispute over the right to use the service or where required by law.
Summary

Everything you upload belongs to you and you are responsible for it. If you want to remove all content, you simply delete your account.

8 Payment of fees

  1. You may pay OMI service fees in cash or by transfer to OMI's bank accounts.
  2. After payment, we will call to confirm and fulfil your request. We send an email notice of the payment cycle at least 3 days in advance. If the fee is not paid on time, your account will be locked.
  3. If you are not in Vietnam, you must comply with the laws and taxes of your region or country.
  4. OMI currently does not support refunds.
Summary

We support several payment methods shown in your OMI account. You are notified at least 3 days before a payment is due; if it is not completed, the account will be frozen. There is currently no refund policy.

9 Modification of services and pricing

  1. Any change to the cost of using OMI will be announced 30 days in advance.
  2. OMI has full rights to change or discontinue the service.
  3. OMI is not liable to you or to any third party when they change their prices or discontinue their own services.
Summary

We may change or discontinue the service at any time and are not liable for doing so.
